Terms of Use

This Terms of Use Agreement is a legally binding agreement between Campitor and the User with regard to using Campitor’s website: https://www.campitorproductions.com/ and the Client with regard to hiring Campitor for a Project. If failing to comply and agree to these terms, the User/Client is ordered to discontinue use of the website immediately. Afterwards the relationship between the Client and Campitor shall end, except for obligation of the Client to pay Campitor for services completed.

Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
User means the individual accessing or using our website, or the company, or other legal entity on behalf of which such individual is accessing or using the website, as applicable.

Campitor (referred to as either "Campitor", "we", "us" or "our" in this Agreement) refers to Campitor Productions.

Client means the individual hiring Campitor for a Project.

Project or Service refers to what the Client is hiring Campitor to complete in exchange for payment.

Privacy Policy

User/Client agrees that by using the Website, they agree to the Privacy Policy.

User Representations

By using this Website and hiring services from Campitor, Client warrants their legal capacity to comply with these Terms of Use; Client is not a minor and is 18 years or older or has the written permission of legal guardian to enter into this agreement.

Management and Oversite

Campitor reserves the right to restrict or deny access to the Website or disable the User/Client’s use of the Website under the sole discretion of Campitor and without notice to the User/Client. All decisions regarding the management of the Website shall be at the sole discretion of Campitor and shall be designed to protect Campitor’s rights and property.

Connection Interruptions

Campitor does not guarantee or warrant the Website will be available and accessible at all times as issues with hardware and/or software may cause errors and interruptions beyond Campitor’s control. User/Client agrees that Campitor shall not be liable to User/Client for any loss, damage or inconvenience caused by User/Client’s inability to access or use the Website during any interruption in the connection or service.

User Data

Client is solely responsible for all data transmitted or any activity completed while using the Website.

Ownership of Materials

Upon final payment, all work created for the Client by use of services fulfilled by Campitor belong to the client. Once payment has been completed, the client is the sole owner of the copyright for all Projects.

If there are issues with the final payment, or the Project is cancelled before final payment, Campitor reserves the right to amend any of the ideas for use by other clients and/or use as concepts in our portfolio.

Should the client attempt to use/modify/alter/replicate or steal any of our ideas without making the agreed final payment, Campitor will take immediate legal counsel.

By providing materials to Campitor for use in the Project, the Client agrees that they are the legal owner of any names and materials used. Should any legal issue arise with the names or materials after the project has been completed Campitor is not legally responsible for any resulting problems and will not issue refunds.

Third Party Fonts

Any fonts/typefaces purchased for the Project are subject to commercial licensing laws, which typically only provide the owner with full rights to use the font/typeface. Therefore, we are unable to provide clients with any fonts/typefaces we use in the final design. Campitor will notify the client of any fonts they will need to purchase to legally reproduce, distribute, or public display the Project.

Client Feedback

Client agrees to provide Campitor everything needed to complete the Project as, when, and in the format needed. Client agrees to review work completed for the Project, provide feedback and approval in a timely manner, and follow the agreed upon payment plan. Client understands that at no point are they forced to accept a direction or idea.

Returns and Refunds

Campitor reserves the right to deny refunds on all Services and Projects based on its own self discretion. Refund requests are determined on a case by case basis. If the Client cancels or terminates the Project, the Client understands that refunds will not be issued if work for the Project has already been delivered. Client is the sole owner and copyright holder of all Project work delivered and paid for. If the Project has not been paid for, Campitor remains the sole owner and copyright holder of all works created.

Showcasing Design Work

Campitor reserves the right to display all completed work, ideas, sketches and other content created for the Project in advertisements, social media, website portfolio, and other public displays unless the Client and Campitor have entered into a NDA.

Electronic communications transactions, and signatures

Client agrees to the use of electronic signatures, contracts, orders, and to electronic delivery of notices, policies and records of transactions initiated or completed by Campitor or through the Website.

Governing Law

If a part of these Terms becomes invalid or unenforceable, the remaining parts of it remain in place. Although the language is simple, the intentions are serious these Terms shall be governed by and construed in accordance with the laws of the State of Texas.

Modification

Campitor reserves the right to change, alter, modify, amend or remove anything on the Website for any reason at its sole discretion. Campitor reserves the right to modify or discontinue all or part of the Website without notice to Client.
